"The Adult Only" neighborhoods usually have age limit of about 55+. If there are going to be two adults and one adult is over 55 the second adult can be younger. The information you have received seems pretty on the mark. If he actually cut down the
entire tree and not just overhanging limbs, it might be best to try to resolve this issue with him directly rather then get into a legal issue. Perhaps he will replace the tree so you can put it on another location further away from his home.

i'm sure you have a HMA, homeowner ass. send a letter to them, explain your situation.
Usually, they go at the house make outside inspection and send them a review with the policies.
They also send how many days they have in order to repair or do the yard.
If they don't do anything, HMA send a company and make the requirement by the policies, and later they send to the owner the bill.
If you don't have HMA, look in your community/town what is the law said.

I am a real estate broker but have a history in landscape design. I just completed a 3 home complex in Clarksville. I used to lecture on xeriscaping and native plants and was a frequent guest on KLRU's Central Texas Gardener. I also have a degree in Environmental Design. There is no charge to meet up and I can give you a quote at that time once I understand the size and scope of the project. Normally the fees for a total master plan drawing might be between $400 and $500. I can also assist in locating plant material and giving instructions for do it yourselfers or refer quality contractors.

Stucco is a great product... it is effectively Portland cement, lime and water, and provides a very durable surface. If installed correctly, it can last many, many years with very little maintenance other than occasional paint.
We see a great deal of stucco (both inside and outside), here in the Chicago area, and it is a very popular finish. Is it "superior" to other walls... such as plaster... I don't really know the answer to that... clearly plaster makes a bad exterior surface, while stucco is an excellent exterior surface. Inside, I think both are good.... more
