The house we rent may have been auctioned. The landlord/owner is in India and we are unable to contact him. How do we find out right away if it was?

Asked by Kimberly Jean, Stockton, CA Sat Nov 5, 2011

We would like a heads up before the last minute asap if we have to move. How will that work? If a bank bought it, will they offer us cash for keys? What if a private party bought it? How much time do we have in either case?

Hi Kimberly,
It is a pain to know all of the sudden you have to move.
There are renters rights in the state of California. ( google California renter rights ) I suggest you look them up to get an idea before someone comes to your door. You can also consult with an attorney.
If you have a lease, make it handy you will need it and you may want to make a copy to hand to the new owner. Consult with your attorney first. You will be required to pay the new owner the rent. If you want out of the lease you were in, then now may be the time - consult your real estate attorney.

Check with a lawyer or with your county to determine your legal rights.

What makes you think the property may have been auctioned? If you've been receiving legal notices, contact the lawyer/firm that's been sending the legal notices.

Call your attorney and provide the attorney with a copy of your lease. In some states, and I don't know if CA is one of them, the new owner must honor the lease. I would suggest you also google landlord and tenants rights for the State of California.
